Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Abide Homes KC website, buyer dashboard, and related services (collectively, the “Service”) provided by Abide Homes KC (“Abide”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you don’t agree, don’t use the Service.

Abide operates an off-market investment property marketplace serving the Kansas City metro area. We surface inventory, schedule showings, and coordinate communication between buyers and our disposition team. Abide is not a licensed real estate broker representing buyers, and nothing on the Service constitutes brokerage representation, investment advice, legal advice, or tax advice. You are responsible for your own due diligence on every property.

You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate information when signing up and to keep that information current. You are responsible for activity that happens under your account, and for keeping your credentials confidential.

You can delete your account at any time by contacting hello@abidehomeskc.com. We may suspend or terminate accounts that violate these Terms.

Property listings on the Service include information supplied by sellers, wholesalers, public records, and our own research. We don’t guarantee its accuracy, completeness, or availability. Pricing, condition, square footage, comparable sales, after-repair-value estimates, and showing times can change without notice. Before making any offer or financial commitment, you should independently verify every fact that matters to you.

When you opt in to email or SMS marketing, you consent to receive automated promotional messages about new property listings, showings, and related updates. Message and data rates may apply. Message frequency varies. You can unsubscribe from email at any time using the link in any message, or stop SMS by replying STOPto any text. You agree not to:

• Use the Service for any unlawful purpose.
• Misrepresent your identity, your investment capacity, or your intent to transact.
• Scrape, copy, or republish property listings or other Service content without our written permission.
• Interfere with, probe, or attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Use the Service to harvest contact information or send unsolicited communications to other users.

The Service, including its design, code, brand, and curated property data, is owned by Abide or its licensors and is protected by applicable intellectual property laws. You receive a limited, non-transferable, revocable license to access the Service for your personal use in connection with evaluating and acquiring investment property.

RSVP’ing to a showing through the Service is a non-binding request for access to the property; access is subject to availability and seller cooperation. Submitting an offer is outside the Service’s scope and follows the process our disposition team coordinates with you directly. Abide is not a party to the purchase agreement between buyer and seller.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted access. Real estate investment involves risk; you are solely responsible for your investment decisions.

To the maximum extent permitted by law, Abide and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed one hundred U.S. dollars ($100).

You agree to indemnify and hold Abide harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party right.

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Jackson County, Missouri, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we’ll update the “Effective” date and, for material changes, give active users reasonable notice by email or in-app banner. Your continued use of the Service after changes take effect is your acceptance of the updated Terms.
